No two criminal cases are the same, and the circumstances that give rise to a criminal charge have to be carefully scrutinized to achieve the best possible outcome for the defendant. Domestic violence charges can be especially problematic, given that the parties involved often have conflicting accounts of how the dispute happened.
For example, a Myrtle Beach woman was recently charged with domestic violence after an altercation with her boyfriend. He told police that she lost her temper and threatened him with a kitchen knife, but she said the boyfriend assaulted her and accused her of cheating on him. The incident reportedly took place after the boyfriend found a rose on the woman’s car.
The boyfriend admitted that he pushed the woman down, but he said he did that after she pulled a knife on him. According to police, the two began arguing after the man found the flower, and he claims that she screamed, broke a chair and said the rose was from another man she is involved with.
A news report doesn’t indicate whether or not either party was injured in the incident, but this may be an issue to consider in the woman’s defense.
Often in domestic violence cases, the facts of the incident in question are not clear at the time of the arrest. It is necessary, then, for a criminal defense attorney to take a closer look at the circumstances that led to the charge. After all, not everyone who is accused of domestic violence is guilty.
