Can surviving family members seek damages following fatal crash?

A South Carolina man recently lost his life after his vehicle was struck by a semi. As with all cases of this nature, it is not uncommon for surviving family members to need answers as to why such tragedies occur. Along with wanting those answers, they may also want to know if they are entitled to seek damages for any resulting economic and non-economic losses as well.

In regard to this particular case, investigators are still trying to determine what may have led up to the collision. As of the latest report, police believe that the driver of a United States Postal Service tractor-trailer, for reasons unknown, crossed the median into the northbound lanes of the I-77 and struck the victim's vehicle head-on. The victim, a 38-year-old male, reportedly died at the scene of the crash.

This incident is said to have occurred in Chester County on Sept. 24. The semi driver, who is a contract worker for USPS, was injured in the wreck. He was taken to a medical facility for treatment. His current condition is unknown. As of this point in time, charges have not been filed in this case.

The unexpected loss of a loved one can be difficult for anyone to bear. This type of situation may seem overwhelming on a number of levels. Those in South Carolina who have lost a loved one in a fatal truck accident may be entitled to seek damages for any resulting losses. Civil claims may be filed against the driver and his employer. Fair and full compensation may be awarded if negligence can be successfully established in court.
