Family of killed motorcyclist may seek damages in civil court

A South Carolina man was riding on his motorcycle when he was struck by a truck near Myrtle Beach State Park recently. Sadly, he died a few days after the incident. While this case is still being investigated, if negligence is believed to have contributed to this man’s death, his surviving family members may seek damages in civil court.

According to a local report, a 56-year-old male was traveling in the northbound lane of Highway 17 on his motorcycle when the driver of a pickup attempted to turn onto a private drive and hit him. He was promptly transported to Grand Strand Medical Center with multiple injuries. After a few days of treatment, his body gave out and he passed away.

Another motorcyclist who was traveling with the victim was also struck. He suffered unspecified injuries and also required medical treatment. His current condition is unknown.

The driver of the pickup — a 56-year-old male — was uninjured in the wreck. This individual has been charged with a right-of-way violation. It is unclear if any further criminal charges are expected in this case.

The surviving family members of those killed in fatal collisions on South Carolina roads are likely to face a number of emotional and financial challenges as a result. In this case, the victim’s loved ones may be entitled to file both survival actions and a wrongful death claim in effort to seek monetary damages. In order for civil claims to be successful, negligence will have to be established in court. With the assistance of an experienced attorney this may be accomplished.
