South Carolina wrongful death: Motorcyclist killed in crash

The South Carolina Highway Patrol recently responded to a collision between a motorcyclist and the driver of an SUV. This incident occurred in Horry County on Tuesday, May 16. Sadly, the motorcyclist died in the incident. Per the laws of the state, the victim's loved ones may be entitled to seek compensation by filing a wrongful death claim in civil court.

A local news station recently reported that a 31-year-old male was operating his motorcycle northbound on S.C. 9 in Longs when, at approximately 3:30 p.m., he collided with an SUV that was exiting a private drive. Authorities report that this individual was not wearing a helmet. He is believed to have died upon impact.

The driver thought responsible for the collision is a 49-year-old female. So far she has been charged with failing to yield. It is unknown if any further charges are pending in this case.

It is unfortunate that many motorcycle accidents have outcomes such as this one, even if the victims are wearing full protective gear. Depending on the causes of such incidents, surviving family members of the victims may have legal recourse. In this particular case, as the driver of the SUV failed to yield the right of way causing the accident, the victim's loved ones may pursue a wrongful death claim in a South Carolina civil court in an effort to seek compensation for their losses. While this in no way replaces the life that was taken far too soon, it can -- if successful -- help reduce any economic hardship that this accident has placed on this young man's family.
