One of the most awful stories in recent years involved the trial of Miles Ferguson of Portsmouth, charged with homicide by child abuse in the death of his daughter Mylee in 2007, while vacationing in Myrtle Beach.
A front-page story in the Portsmouth Daily Times showed Ferguson and attorney L. Morgan Martin tearfully embracing as the not guilty verdict was read. This was a case of a lengthy jury trial that led to a just conclusion. The baby had never been mistreated in any way. The actual cause of death was a brain hemorrhage occurred at birth.

A recent South Carolina court ruling says a person can be charged with homicide by child abuse if he or she “causes the death of a child under the age of 11 while committing child abuse or neglect, and the death occurs under circumstances manifesting an extreme indifference to human life.” Aiding and abetting another person in abuse or neglect that leads to death can be also prosecuted as homicide.
